FBI Announces Anti-corruption Campaign for Nevada

The FBI and the U.S. Attorney’s Office for the District of Nevada announced a corruption awareness campaign at the FBI’s Las Vegas office on Feb 22, 2023. Can’t get a golf tee time?

Can’t get a tee time?  In the survey we conducted, several respondents complained that they could not get golf tee times. One resident suggested, “More available tee times for residents. i.e.: less shotgun starts. Letting players tee off on the back nine at championship in the morning.  Another resident complained that it can be difficult for a single golfer to join a 2-or 3-some, even if they can be observed teeing off at the first hole, but a single player cannot book a tee time. Trashing the IVGID Quarterly

For the last 7 years, IVGID published the IVGID Quarterly. This full-color glossy magazine is mailed to all property owner of Incline Village and Crystal Bay. Now published FIVE times a year, the name has changed to “IVGID Magazine”. What is wrong with this? 1. IVGID is organized under NRS 318. There is no statute authorizing a General Improvement District to produce a magazine or mass mailing such a publication. Therefore, IVGID should NOT be publishing the  magazine. Beach Deed Opinion Released-IVGID employee access not authorized

UPDATE: March 27, 2023 – In the March 22, 2023 IVGID Board Meeting, Chair Dent proposed spending ANOTHER $50,000 on legal services with Thorndal regarding the Beach Deed. This item has been deferred to April 5, 2023 as the agenda item lacked “supporting infomation”  (per the meeting synopsis provided by IVGID).  Once again, residents will have to lobby the Trustees so their taxpayer funds are not wasted.  CLICK to send an email to trustees. Digging into Funding for the Effluent Pipeline Project

Since receiving funding from the Army Corps of Engineers (USACE) for Phase 1 of the Effluent Pipeline Project (2004-2009), IVGID has told residents that USACE Section 595 funds would be obtained. These funds would pay for part of the Effluent Basin and Phase 2 of the Pipeline Project. From 2008 to date, IVGID has paid Marcus Faust, a lobbyist $920,000 [source: ProPublica – graphic below]. However, from 2011 on, IVGID has received no federal funding from USACE. How does one obtain funding?   In December 2021, a legal firm (Thorndal) was retained by the IVGID Board to deal with compliance with the beach deed. Thorndal’s  engagement letter stated: This project will include the following: • Reviewing any proposed changes to Ordinance No.7 and Policy 16.1.1 to ensure compliance with the beach deed and applicable law. • Reviewing the existing practice of providing recreational privileges, including beach access, to non-resident employees, their paid guests, qualified retired employees and some former Trustees without regard to their residency, to ensure compliance with the beach deed and applicable law. Accounting Cover-up?

Background What words strike fear in executives, accountants, auditors and investors? Restatement of financial reports. This article explains the contortions that IVGID management and Board underwent to avoid restating financial reports. IVGID has no Whistle Blower Ordinance, even though required by Nevada law since 2019. (NRS 281.635) For years, residents including several CPAs protested IVGID’s annual audited financial statements, especially the 2015 switch of the community venues from “Enterprise Fund” accounting which is to be used for business-type activities.  Public records requests for the detail supporting the statements (General Ledger and Chart of Accounts) were refused.
