State Places IVGID on Fiscal Watch Amid $740,411 Cash Discrepancy and Audit Failures

INCLINE VILLAGE, Nev. – The Incline Village General Improvement District (IVGID) has been placed on fiscal watch by Nevada’s Committee on Local Government Finance (CLGF) after receiving its fifth extension to submit audited financial statements for fiscal year 2024. The decision was announced at a public Zoom meeting on April 29, 2025, with a firm warning from CLGF Chair Marvin Leavitt that he would be “very unhappy” if IVGID does not provide audited financials by this revised deadline.   Mr. Leavitt did not further explain what “very unhappy” meant. Nevada Department of Taxation fails to protect taxpayers

On March 4, 2025, the Department of Taxation approved IVGID’s request to delay submitting its audit report for the fiscal year ending June 30, 2024, until March 25, 2025. This decision has left many questioning the state’s oversight role and IVGID’s competence in managing public funds. IVGID requests extension for audit report – again

Once again, the Incline Village General Improvement District has requested an extension for filing its audited financial statements with the Nevada Department of Taxation.  Interim Finance Director submitted the request for a 69 day extension on November 21, 2024.  Since August, every time the question has been put to IVGID on whether staff expected to complete its audit in a timely manner, the answer has been yes. Were IVGID staff really being truthful? For its 2023 fiscal year, IVGID requested three extensions. State considers “fiscal watch” for IVGID

[Update Oct 24, 2024: The Local Government Finance Committee selected a sub-committee to determine whether IVGID will be placed on “fiscal watch”. The sub-committee members are Gina Rackley, Josh Foli, and Jeffrey Share. Nevada is a Dillon’s Rule State which limits local government power: Governor Lombardo

When Governor Lombardo vetoed a bill for rent control and affordable housing in 2023, he cited Dillon’s Rule. Below is his official veto. “Nevada is a Dillon’s Rule state. This means the power of a local government is limited to powers expressly granted to the local government by the Nevada Constitution or the Nevada Legislature, the powers necessarily or fairly implied in or incident to the expressly granted powers, and other powers proper to address matters of local–but not statewide-concern.”

In 1961, the Incline Village General Improvement District was created for the purpose of street paving (including curbs and gutters), sidewalks, storm drainage, sewage disposal and water supply.   Note that “facilities for public recreation” was not part of Ordinance 97 originally; this word was ONLY added in 1965. In 1964, Trash management was added, as well as street lighting. Therefore, IVGID is authorized for the purpose of  street paving (including curs and gutters), sidewalks, storm drainage, sewage disposal and water supply, street lighting, trash management, and public recreation facilities. Nevada Public Records and Confidentiality

Nevada’s Public Record Act makes all public records accessible unless they are specifically excluded by law. In the past, the Incline Village General Improvement District  or its general counsel has cited Nevada Administrative Code (NAC) as the reason why public records are denied. This is likely a violation of Nevada Law.
